In a shocking move, a lawyer for parents Connie Yates and Chris Gard told Mr Justice Francis that “time had run out”.

Lawyer Grant Armstrong said: “For Charlie it is too late. The damage has been done.”

His parents want to treasure what time they have left with him, and are discussing the immediate future with Great Ormond Street Hospital (GOSH).

Mr Armstrong said they wish to decide how Charlie should be allowed to die.

The pair had challenged the courts in a lengthy legal battle in a bid to take their 11-month-old son the the US for experimental treatment.

The latest hearing today, Monday, has seen his devoted parents end their fight in the courts.

The pair announced their decision as a High Court judge was preparing to oversee the latest round of a five-month legal battle.

As she left the court, Ms Yates wept: “We are sorry we could not save you.”

Despite the fact that lawyers had represented Charlie for free, the judge siad Ms Yates and Mr Gard, along with other parents in similar positions, should have been entitled to legal aid and suggested a review.

After the judge concluded his remarks, Ms Yates told the court from the witness box: “We only wanted give him a chance of life.”

She said “a whole lot of time has been wasted”.
