A BRITISH court has recognised Sharia law for the first time ever in the UK, marking a historical turnover to the way Islamic marriage and divorces could be viewed in the court of law.

A high court judge declared a wife could claim her husband’s assets, despite them marrying in an Islamic ceremony called a nikah, which is not legally recognised in the UK, ruling that their wedlock fell under British matrimonial law.
The decision came after Nasreen Akhter divorced her husband, Mohammed Shabaz Khan, who attempted to block her separation on the basis that they were not “legally married” under
English law and “under Sharia law only”.
However, the High Court ruling deemed the couple lived as husband and wife, and their union should be valid and recognised because they had similar expectations to a British marriage contract.
This paves the way towards more rights for women married under Sharia law, making it easier for them to divorce their husbands and split their assets.
A report earlier this year, commissioned by Prime Minister Theresa May when she was Home Secretary, revealed that many women in Islamic marriages realise they do not have legal protection under UK law, unless they have a second civil marriage.
Mrs Akhtar’s husband, Mr Khan attempted to block their marriage because the couple were not legally married in the UK.
However, High Court judge Mrs Justice Williams said the marriage was “entered into in disregard of certain requirements as to the formation of marriage”.
