Judicial Watch’s chief investigator Chris Farrell joined the Fox Business Network to explain why he believes the manner in which Deputy Attorney General Rod Rosenstein authored the “secret memo,” outlining Special Counsel Robert Mueller’s authority (after raiding the home of Trump campaign manager Paul Manafort), should amount to his termination.

“Farrell: “It’s a really gross abuse of due process. If you’re going to charge somebody criminally, there are procedures for doing so. One of the fundamental pieces is called Brady Material. That is if you’re going to charge somebody and prosecute them criminally, you have to put all the cards on the table. You have to explain what it is they are being charged with and how and why.

You can’t have secret stuff, and that’s what really happened here. You have Rosenstein, frankly, a guy who has a long track record of weird abusive practices up in Baltimore. Rosenstein issuing this secret authorization, Manafort’s attorney saying ‘wait a minute, you’re outside the scope of the special counsel authority grant, what are you doing looking at stuff from 2006 that has nothing to do with the Trump administration?’ And then they go, ‘oh wait a minute, we have a special letter here. We get to go anywhere we want and do anything we want.’

They are abusing the system. They’re hunting for scalps and will do anything to get them.

The thing that is particularly offensive about this secret authorization is they claimed it was classified and then they submitted it to the courts. Well, which one is it? Is it really a classified document? Or is this something that goes into the public record as part of a criminal court proceeding? You can’t have it both ways. There is even a tension, a disconnect there that shows you the way in which they are abusing the regular due process criminal procedure to do any damn thing they want. This alone is grounds to can Rosenstein in my opinion.”

As The Gateway Pundit previously reported, Mueller and Rosenstein presented to the courts a rebuttal for Manafort’s latest action – they presented a previously undisclosed memo to a federal court in Washington supposedly addressing Manafort’s argument.

The memo is dated August 2nd, 2017 and is from Rosenstein to Mueller supposedly directing Mueller to look into Manafort actions with a Russian operative perhaps before 2016.

This, however, is clearly outside the scope of Sessions’ recusal as argued by Manafort and doesn’t even address Manafort’s argument that these actions are not for Mueller to take or Rosenstein to order but are Sessions actions alone as Attorney General.

In January, Manafort filed a civil lawsuit in a D.C. court against Mueller, Rosenstein and the Justice Department, alleging the special counsel went outside of the investigation’s scope.
