BRITAIN leaving the European Union (EU) could result in Spain swooping in to claim Gibraltar as its own due to a legal quagmire Brexit would produce.

The rock nation’s future is yet again hanging in the balance over threats its citizens will opt to stay in the EU, but attempt to remain a “British Overseas Territory”.

Chief Minister of Gibraltar Fabian Picardo’s startling revelation would leave the country’s status up for grabs as it gets tangled up in the legal complexities of the EU.

Gibraltar has traditionally been a fiercely loyal supporter of the Crown, but its inhabitants will seek to gain a special status with Brussels to prevent a backlash from Spain and a meltdown of its economy if its border was closed.

Earlier this week Spain showed how serious it is by threatening to close its border if Britain votes to leave the EU

Speaking exclusively to Express.co.uk, Mr Picardo, said: “The future for Gibraltar, after a potential ‘Brexit’ is uncertain.

“Why would Gibraltar want to risk that uncertainty and lose the prosperity which we currently have as being in the EU?”

He accused the Leave campaign of “chasing rainbows”.
